Decision in Communisis Plc v The Tall Group of Companies Ltd & Ors [2020] EWHC 3089 (IPEC) (17 November 2020)

On 17th November 2020, the High Court of Justice, Business and Property Courts of England and Wales, Intellectual Property Enterprise Court (ChD) ruled that The Tall Group of Companies Limited, Checkprint Limited, DLRT Limited's method of generating cheques printed with a unique coded number (the “TALL System”), and cheques (and any other products) generated according to the TALL System, do not infringe Communisis Limited's UK Patent No. GB2512450B.

Further, the Intellectual Property Enterprise Court ruled that claims 1 and 6 of UK Patent No. GB2512450B are invalid. Accordingly, UK Patent No. GB2512450B has been revoked.

Communisis Limited will not seek to appeal this judgment.

For the avoidance of doubt, this does not impact Communisis’ ability to offer fraud protection on our cheque production either in regards to our original ‘UCN’ system or to our enhanced ‘EUCN’ offering. We respect the decision of the court, which provides clarity regarding the protectability of cheque security technology through the patent system, and welcome future open market, fair competition.
